Part VII

32. Discipline.

(1)       The Council shall forward all complaints to the Investigation Committee appointed in terms of section 55 of the Act for investigation.

(2)       In determining and investigating complaints brought to the Council the Investigation Committee shall consider whether or not there are reasonable grounds to pursue the allegation.

(3)       Where the Investigation Committee decides that the allegations contained in the complaint do not constitute reasonable grounds to pursue the allegation, it shall refer the matter back to the Council with its findings.

(4)       Where the Investigation Committee determines that there are reasonable grounds to pursue the allegations it shall submit a written report referring the complaint to the Disciplinary Committee appointed in terms of section 58 of the Act.

(5)       The disciplinary procedure provided for in Part X of the Act shall be followed in all disciplinary proceedings.

34. Course contents and examinations.

The Council shall be entitled to have an input in the course contents and examinations of all architectural, engineering, surveying and allied professionals’ courses in all the recognized institutions.

35. Amendment of Schedules.

The Minister may, at any time, by notice published in the Gazette amend any of the Schedules to these Regulations after consultation with the Council.

36. Scale of fees for professionals.

The Minister shall, in consultation with Council, issue, from time to time guidelines on the rates of fees to be charged by architects, engineers, surveyors and allied professionals.

37. Subscription fees

The Council shall from time to time prescribe subscriptions to be paid by its members and the manner of paying such subscriptions.

38. Special dispensation. 

(1) Where an Applicant has been working without registration in Swaziland for more than fifteen (15) years, that applicant may file a special application to be registered as a professional under this regulation.

(2) The application shall be accompanied by –

           (a)  proof of payment of the administration fee prescribed in the Second Schedule;

           (b) a curriculum vitae for evaluation by a committee appointed by the Council.

(3)  An applicant who succeeds in the evaluation shall be registered as a candidate and may qualify for a special Professional Assessment Examination (PAE), but shall not be required to complete an internship period.

(4) The Council may, after an oral interview, exempt any professional contemplated in this regulation from sitting for a written examination depending on the principles of each profession and the examination rules approved by the Council.  

(5)  Upon passing the Professional Assessment Examination (PAE), the applicant shall immediately be upgraded to a professional registration category.

(6)  Upon being up-graded to a professional registration category the applicant shall be charged pro rata annual fees based on the normal fees paid by all registered persons in the particular category.

(7)  The application, examination and upgrade fees are prescribed in the respective schedules.

39. General Offences and penalties

(1)   A person shall not work as a candidate or architect, engineer, surveyor, allied professional or technologist or technician without a valid registration certificate issued by the Council.

• A person or entity that fails to comply with a provision of these Regulations commits an offence and where no penalty is provided under the respective provision of the Act, such person shall be liable to a penalty not exceeding E50,000.00 fifty thousand Emalangeni or to imprisonment for a period not exceeding five years or to both.
